These terms explain your rights and responsibilities when using Gathrly. By creating an account or using our services, you agree to these terms.
1. Introduction
Gathrly is operated by GathrlyMY (a Malaysian business entity). In these terms, "we" refers to Gathrly, and "you" refers to the user of the service.
By registering or using Gathrly, you confirm you are 18 years or older and have the legal right to enter into this agreement.
2. Host Account
As a host (event organiser), you are responsible for:
- Security of your account including password
- Content of events you create
- Actions taken using your account
- Verifying your email before creating events
One account is for personal or event use. You may not share or transfer your account to others.
3. Content & Photo Ownership
Important: We do NOT claim rights to photos you or your guests upload. We only store photos so you can access them.
You retain ownership of photos you upload. Guests who upload also retain ownership of their photos.
You are responsible for ensuring your event content does not violate others' rights. If we find content that is illegal or infringes copyright, we may remove it without notice.
You may delete all photos of your event at any time after downloading.
4. Acceptable Use
Gathrly is only for legitimate events. You are prohibited from using the service for:
- Content violating Malaysian law
- Obscene, harassing, or harmful content
- Copyright or intellectual property infringement
- Fraudulent activity or impersonation
- Spam or unauthorised marketing
We reserve the right to suspend or terminate accounts that violate acceptable use without notice.
5. Payments & Refunds
All prices are shown in Malaysian Ringgit (MYR) or US Dollar (USD). Payments are processed via Chip (chip-in.asia), which supports FPX, e-wallets, and international cards.
Refund policy: you are eligible for a refund if the QR has not been scanned and no photos have been uploaded, within 7 business days of payment. Gateway processing fees (~3%) will be deducted.
Alternative: you can change your event date at no charge as an alternative to refund.

6. Storage & Automatic Deletion
Photos are stored for the duration of the plan you chose (7 to 60 days). After the period ends:
- Gallery is locked — guests cannot upload or view
- You receive an email reminder 3 days before the period ends
- You can extend the period (RM29 = +30 days)
- Once the internal storage period fully ends, photos are permanently deleted
You are responsible for downloading photos (ZIP) before the period ends. Gathrly is not liable for photo loss after automatic deletion.
7. Privacy
We collect minimal personal data and comply with the Malaysian Personal Data Protection Act (PDPA) 2010. See the Privacy Policy page for details on data we collect and how we use it.
We strip GPS location data from uploaded photos as a privacy commitment to your guests.
8. Limitation of Liability
The service is provided "as is" without implied warranty. We work hard to ensure availability and security, but cannot guarantee the service is free from interruption, errors, or data loss.
Our maximum liability is limited to the amount you paid for the service in the 12 months before the claim is made.
We are not liable for photo loss after the storage period ends — you must download photos before that date.
9. Termination
You may delete your account at any time. After termination, all your data will be deleted according to our retention policy.
We may terminate your account if you violate these terms. We will provide notice where possible, but serious violations may result in immediate termination.
10. Changes to Terms
We may update these terms from time to time. Changes will be communicated via email or notice on the website. Continued use after changes constitutes acceptance of the new terms.
11. Governing Law
These terms are governed by Malaysian law. Any disputes will be resolved in Malaysian courts.
